Man gets 10 years for downloading child pornography

A Billings man who admitted downloading child pornography on his computer will spend more than 10 years in federal prison. In sentencing Timothy Dewayne Carpenter, 40, on Thursday, U.S. District Judge Richard Cebull departed upward from the guideline range and then gave him the longest term possible - 10 years and one month - for receiving child porn. He also sentenced Carpenter to five years in prison for possessing child porn; the terms are to run concurrently.....

In determining the initial guidelines, Cebull enhanced the range by finding that Carpenter's behavior was a pattern of abuse, that the victims were vulnerable and under the age of 12 and that the images were sadistic or violent.

The judge, who reviewed a notebook of the child porn images taken from Carpenter's computer, said that " 'grotesque' would be the word used to describe'' the pictures.

Defense attorney Kelly Varnes objected to the upward departure, saying Carpenter has not been convicted of sexually abusing minors. Varnes argued for a downward departure, saying Carpenter was molested as a child by older boys and a relative.

Assistant U.S. Attorney Marcia Hurd said Carpenter's background makes him dangerous and that leniency was inappropriate.

Carpenter pleaded guilty to charges of receiving and possessing child porn through interstate commerce on his home computer in early September 2001. He waived his right to have a jury decide facts that could lengthen his sentence in favor of having the judge decide.

Hurd said an investigation of Carpenter began when a child reported that he and another child had been sexually abused by him.
